Feature: Terms and Conditions - Docu Magazine

⚖️ Terms and Conditions ⚖️

This Terms and Conditions statement is not limited to Docu Magazine’s the Open Call, but includes all content, images, texts, files, courses, masterclasses, mentor programs, workshops, print shops, magazines, books etc. that can be found on Docu Magazine’s web pages and Docu Magazine’s social media.

Each submission must be an original work of entrant and not infringe or violate any copyright, trademark, right of publicity or privacy, trespass, nuisance, misleading and deceptive conduct, passing off, or other intellectual property or contractual, statutory or tortious rights of any person or entity and must not be defamatory, racist or, in the absolute opinion of the Sponsor Entity offensive. Only digital entries will be accepted.

When your project is being published, the photos will/might appear in the printed Docu Magazine, in documagazine.com website, Docu Magazine’s social media platforms such as Facebook, Instagram, Youtube, Vimeo and others – or in Docu Academy as educational material. Docu Magazine / Docu Academy may use the material that the students or photographers send, post or upload in Docu Academy’s Courses, Mentor Programs, Masterclasses, Portfolio Reviews, or Docu Magazine’s Open Call options, but will never use any material without mentioning the photographers name.

No image will be published without the photographers name. No image will be sold to a third party entity. The photographer owns the copyrights to their images.

Payment needs to be made within 14 days of the receiving of the bill, if payment is not being made in 14 days, Docu Magazine has the right to use the images in whatever context Docu Magazine wants, or sell the images, print the images, or sell them online without asking the photographer. However the name of the photographer is always mentioned with the images they have sent, posted or uploaded to Docu Magazine / Docu Academy. For Docu Academy’s Masterclasses, Mentor Programs, Workshops and other learning services the payment needs to be made within 14 days of the receiving of the bill.

After the payment is made, copyright ownership in the Submissions remains vested entirely with the Entrants/Author. The Sponsor Entity will make best endeavours to credit the Entrant’s Submission but is not liable for any inadvertent failure to do so or due to the neglect or fault of third parties. The Entrant is encouraged to notify the Sponsor Entity of any omission of their credit and the Sponsor Entity shall take reasonable steps to seek to rectify the omission but is not liable if a third party responsible and with control of publication declines or neglects to rectify the omission despite such reasonable steps taken by the Sponsor Entity.

By entering, all entrants warrant and represent that (a) their respective Submissions are their own 100% original creations; (b) their respective Submissions do not incorporate any intellectual property from any third parties (without appropriate releases); and (c) that their submissions do not violate any rights (including any rights of privacy, trespass, nuisance, misleading and deceptive conduct, passing off, rights of publicity or copyrights) of any third parties. (d) acknowledge that where applicable these Official Rules are a consent to use adaptation and publication for purposes of the Entrant’s Moral Rights whilst the Entrant’s Moral Rights are asserted and acknowledged.
